These Terms & Conditions form a binding agreement between PreneurShip, a sole proprietorship operating under the brand Medikunj (“Medikunj”, “we”, “us”, or “our”), and the person or organisation accessing or using our services (“you” or “Customer”). If you use Medikunj for an organisation, you confirm that you have authority to bind it.
By accessing medikunj.com, creating an account, signing an order form, clicking to accept, or using the service, you accept these terms. If you do not agree, do not use the service.

These terms, our Privacy Policy, and any accepted order form, proposal, statement of work, data-processing agreement, or service-level agreement make up the complete agreement. A signed document controls if it expressly conflicts with these online terms on the same subject.
Medikunj services
Medikunj is cloud-based software for hospitals, nursing homes, clinics, and healthcare professionals. Features may include patient registration, appointments, OPD/IPD, EMR, admission and discharge, nursing, pharmacy, laboratory, radiology, inventory, billing, claims, finance, analytics, communications, and multi-location administration.
Selected plans may also include AI-assisted workflows; ABDM/ABHA, HL7/FHIR, payment, laboratory, pharmacy, and communication integrations; and agreed implementation, migration, configuration, training, or support. Your order form or plan determines enabled modules, usage limits, fees, implementation scope, and support level.
Accounts and customer responsibilities
You must be legally capable of entering a contract and provide accurate, current account, organisation, and billing information. The Customer is responsible for its authorised users and must:
- Keep credentials confidential, use individual accounts, and promptly disable access when a user's role changes or ends.
- Assign appropriate role-based permissions and maintain suitable devices, networks, endpoint security, and internal procedures.
- Keep patient, clinical, staff, tariff, tax, inventory, and billing records accurate and appropriately configured.
- Obtain all notices, consents, permissions, and other lawful authority required to collect, use, and share information through Medikunj.
- Promptly report suspected account compromise or security incidents to supratik@medikunj.com.
Clinical safety, emergencies, and AI
Do not use the platform as a substitute for emergency care. In a medical emergency, contact the appropriate emergency service or a qualified healthcare professional immediately.
Medikunj supports administrative and clinical workflows but does not diagnose, prescribe, recommend a provider, or replace professional judgement. Qualified healthcare professionals remain responsible for diagnoses, prescriptions, orders, results, treatment, discharge, and all patient-care decisions.
AI-assisted outputs are drafts or decision-support material. They may be incomplete or inaccurate and must be reviewed, corrected, and approved by an authorised professional before use in care or a final record. Customers must provide any legally required notice and obtain consent before submitting audio, images, documents, or health information to an AI feature.
Patient data, privacy, and security
As between the parties, the Customer retains control of patient, clinical, workforce, and operational data submitted to Medikunj (“Customer Data”). The Customer determines why records are created, who may access them, and how long they are retained, subject to law. Medikunj processes Customer Data only to provide, secure, support, and maintain the contracted service and as otherwise permitted by the agreement or law.
- Customers must use ABDM/ABHA features through applicable consent and programme workflows.
- Each party will apply reasonable safeguards within its control and cooperate on security incidents and lawful requests.
- No online service is completely secure; Customers should maintain appropriate continuity procedures and exports where required.

Acceptable use
You and your authorised users must use Medikunj lawfully and must not:
- Access records without a legitimate purpose or upload unlawful, infringing, deceptive, harmful, or unauthorised content.
- Share accounts, impersonate another person, introduce malicious code, send spam, or interfere with another user or the service.
- Probe or bypass security, usage, or access controls, or attempt unauthorised access to accounts, systems, or data.
- Scrape, frame, resell, sublicense, copy, reverse engineer, or use the service to build a competing product, except where law expressly permits.
- Use automated methods in a way that disrupts the service or exceeds documented limits.
We may investigate suspected misuse, preserve relevant evidence, remove unlawful content, and take proportionate technical or legal action.
Fees, renewals, and refunds
You agree to pay the fees, applicable taxes, and other charges stated in your plan, invoice, or order form. Unless stated otherwise, fees exclude GST. Recurring plans renew for the stated billing cycle until cancelled under the applicable commercial terms.
- You authorise Medikunj and approved payment processors, including Razorpay, to collect applicable charges.
- Complete card details are handled by the payment processor and are not stored on Medikunj servers.
- Failed or overdue payments may lead to restricted features or suspension after reasonable notice.
- We may change pricing for a future renewal period by giving reasonable advance notice.
Cancellation stops future renewal but does not ordinarily reverse fees already incurred. Fees are non-refundable unless required by law or expressly agreed in a refund policy, order form, or other written commercial document. Professional-service fees are non-refundable once the associated work begins, except where agreed otherwise in writing.
Ownership, content, and confidentiality
Medikunj materials
Medikunj and its licensors own the software, code, workflows, interfaces, designs, documentation, branding, and related intellectual property. Subject to payment and compliance, we grant the Customer a limited, non-exclusive, non-transferable, revocable right during the subscription term for authorised users to use the service for internal operations.
Customer Data and feedback
Customers retain their applicable rights in Customer Data and grant Medikunj only the limited rights needed to host, process, transmit, back up, and support it. Customers confirm that they have authority to provide that data. We may use voluntary product feedback without payment or restriction, without publicly identifying the provider unless permitted.
Confidentiality
Each party will use reasonable care to protect the other's non-public business, technical, security, health, and commercial information; use it only for the agreement; and disclose it only to people who need it and are bound by suitable obligations. This does not cover information lawfully public, independently developed, already known, or lawfully received without restriction.
Integrations, availability, and changes
Third-party services—including cloud, payment, communication, scheduling, AI, ABDM/ABHA, laboratory, pharmacy, insurer, and customer systems—may have their own terms, privacy practices, fees, and availability. Medikunj is not responsible for their independent acts or outages. We may replace or discontinue an integration if its provider changes access, security, or legal requirements.
We aim to provide a reliable service, but interruptions may occur because of maintenance, internet or utility failure, customer systems, third parties, security events, or events beyond reasonable control. A specific uptime or support commitment applies only if stated in a signed service-level agreement.
We may improve, replace, or discontinue features. Where practicable, we will give reasonable notice of a change that materially reduces core paid functionality.
Suspension, termination, and data export
We may suspend access where reasonably necessary to address a security threat, unlawful activity, material breach, overdue payment, risk to the service or another user, or a legal requirement. Where practicable, we will give notice and an opportunity to remedy the issue.
Either party may terminate as provided in the applicable plan or signed agreement. On termination, access ends and outstanding amounts remain due. Subject to payment, legal restrictions, and the agreed process, the Customer may request a standard export of Customer Data during the applicable transition period. Data may then be deleted or retained as required by law, security, backup cycles, or our Privacy Policy.
Provisions concerning ownership, confidentiality, accrued payment obligations, disclaimers, liability, disputes, and any terms intended by their nature to survive will continue after termination.
Warranties, indemnity, and liability
Service disclaimer
To the maximum extent permitted by law, Medikunj is provided “as is” and “as available”. We do not warrant uninterrupted or error-free operation or fitness for every clinical, regulatory, accounting, insurance, or operational requirement.
Customer indemnity
The Customer will defend and indemnify PreneurShip and its personnel against third-party claims, losses, and reasonable costs arising from the Customer's unlawful use, Customer Data, breach of these terms, infringement of another's rights, or clinical or operational decisions—except to the extent caused by Medikunj's breach, negligence, or wilful misconduct.
Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, exemplary, or consequential loss, or loss of profit, revenue, goodwill, or business opportunity. Medikunj is not responsible for inaccurate Customer Data, unauthorised Customer access, clinical decisions, misuse, or failures of Customer or third-party systems.
PreneurShip's total aggregate liability arising from the service will not exceed the fees paid for the affected service during the three months before the event giving rise to the claim. Nothing in these terms excludes liability that applicable law does not allow to be excluded or limited.
Governing law and disputes
These terms are governed by the laws of India. Before filing a formal claim, each party will give written notice describing the dispute and allow 30 days for good-faith resolution by authorised representatives.
If the dispute is not resolved, and unless a signed agreement specifies arbitration or another process, the courts in Kolkata, West Bengal will have exclusive jurisdiction, subject to any mandatory statutory forum or remedy. Either party may seek urgent interim relief to protect data, security, confidentiality, or intellectual property.
General terms and contact
- Changes: We may revise these terms and will provide reasonable notice of material changes. Continued use after the effective date means acceptance.
- Notices: We may send operational or legal notices through the service, account email, or website. Legal notices to Medikunj must be sent to the contact below.
- Force majeure: Neither party is liable for delay caused by events beyond reasonable control, except for payment obligations already due.
- Assignment: You may not assign the agreement without written consent. We may assign it in connection with a reorganisation, financing, merger, acquisition, or business transfer.
- Severability and waiver: An unenforceable provision will be limited to the minimum necessary. Failure to enforce a term is not a waiver.
- No partnership: The agreement does not create an agency, employment, partnership, or joint venture.
